Trustee Resignation

This template is a Trustee Resignation that may be used in California. It is designed for voluntary resignations by a trustee who has capacity and either no longer wishes to act as trustee, or is no longer able to act as trustee. This Resignation of Trustee template includes practical guidance and drafting notes. California Probate Code §15640 states that the resignation of a trustee may be accomplished as provided in the trust instrument (amongst other ways). Prior to drafting a resignation of trustee, it is advisable to review the trust document. A trust instrument will typically require the resignation to be written, signed, and delivered to a trustor (if living), or to a successor trustee if the trustor(s) is/are no longer living.
